believe that we are rushing this at a rate that does not give us the ability to support. >> commissioner borden. >> i feel quite a bit differently. you know, we have -- the fundamental difference in this project and the project we saw a couple years ago was full demolition of the older building, which was pretty much been kind of a shed standing for quite sometime versus a total demolition. i mean, i always argue about i'm not always confused about de facto or actual demolition. but in all intents and purposes, the previous project we approved didn't even look like the same project although it was not considered a total demolition. now we have a total demolition and we basically have fundamentally the same project before us. the issues, we may have -- we have drawings in front of us and maybe they're not color rendering. but substantially everything about this project, the size and the scope, the only difference that we talked about is the size of the use for the restaurant there being whether or not it was commercial use, other commercial use incorporated. but i haven't actually heard a

. approval of the special use district violates the conformity requirement of state law. the proposal to adopt the so-called special use district, the one parcel of land is for the express purpose which is to grant the owner an exemption from numerous zoning rules is in essence a variance. as such, the city must comply with the procedures and make the substantive findings required by state and city law for approving a variance, which this proposal fails to do. the pagoda theater site is obviously much better than the columbus avenue extraction. we have worked and supported. our neighborhood merchants and neighbors not disrupting the business community for over a year or two. we also have a strong feeling that the pagoda site's $9 million expenditure to extract tbms which have salvage value at most 4.4 to $6 million is illogical. by not even extracting the machines at the pagoda, by varying the machines as has been done in new york city, in brisbane, australia, in the tunnel in the english channel, where machines are either lowered below tunnels or shifted to the side or [speaker not u

being cost effective. using the pagoda as central subway corporation yard if you will, raise the building, put a shaft down, is fraught with instruction problems due to the water flow problem in the basement pointed out by letter from sav e muni. there are lower cost alternatives. unless this information we don't know about % leave the tunnel-boring machines buried, under the pagoda theatre or extract them from the chinatown station. extracting them or burying them at chinatown would save 80 million dollars. by doing that it would not impact the people, residents, businesses of north beach. when you consider the use of this building for an extraction site it should be denied. i think it is an expensive project. it is disruptive. there are a lot better alternatives. thank you for your time. >>: and if further general public comment? seeing none general public comment is closed. >>: this will place you under your regular calendar. items 10 a-c have been continued to feb. 14. items 4 and 5 have been pulled. >>: request from commissioner antonini. >> commissioner antonini:

use and rezonings. that didn't prove to be economically feasible. silver leathers came before the commission. however, this is the first one by mr. campos, my client, and i was at the commission in 2009 when you approved this 6 to 1 with dozens of community members supporting it in 2009. unfortunately, as you know in that period, the econ kind of fell apart and financing and so did equity. and when you approved, it was not a good time to get financing and start construction. * economy now the aloe am -- economy has come back, lending is available. the client is ready to go forward and start with all the final permitting when the city claim to the client a few months ago and asked that his construction be delayed by reason of using the site for up to two years for removing the boring equipment. and since then my client has agreed to delay his construction. and there are some risks. however, it seems like it's what's best for the city and the neighborhood, and was willing to come back before you and is today on essentially the same project. but instead of a demolition -- excus

, the conditional use applications, the amendments to the zoning, zoning map, bulk, height, and although issues. i have a package which i will submit at the end of my testimony which elaborates those issues. i will try to paraphrase the key issues. one, a subsequent or supplemental e-i-r is required to access the environmental impacts of altering the alignment and terminus of the subway tunnels north of chinatown station. to change the tpm extraction location from columbus avenue to pagoda theater parcel. included in this package is a [speaker not understood] and geotechnical report, a letter from the various teams, geotechnical [speaker not understood] larry carp. there are issues also which include issues of dewatering and impacts on very fragile adjacent buildings. two, the subsequent and supplemental e-i-r is required to assess the impact thev historic resources which were not included in the previous e-i-r or the current evaluations. and finally, three, the subsequent supplemental [speaker not understood] to assess the environmental impacts of expanding central subway service north beach. so,

it was continue to february 25th. this week at the land-use committee hearing they had the car sharing parking ordinance sponsored by supervisor wiener. he wanted to allow south side spaces such as parking lots that had been in place for at least a year, they wanted the same number of spaces. he wanted to cap the maximum for residential and commercial buildings, and requiring signage for the spaces. he wanted to ensure that these spaces will be allowed for projects not seeking a cu. wanted to provide the planning department with more enforcement excitation power. -- -- our department has been asked to develop the signage requirement for the car share spaces. there were three speakers in opposition and one speaker in support. board president chu expressed concern over enforcement but stated enthusiasm for the potential development of new enforcement measures. it was recommended for approval by the full board. we have a host of new ordinances and hearing requests. first for the commission and the historic reservation commission supervisor wiener has introudced a version of the
